Facilities Waiver of Liability & Photo Release

  • In consideration of my/our child, named above, use of the exercise equipment and facilities provided by Saint Vincent Archabbey and College, I/we expressly agree and contract, on behalf of myself/ourselves, my/our heirs, executors, administrators, successors and assigns, that Saint Vincent Archabbey, the Benedictine Society of Westmoreland County, Saint Vincent College, Saint Vincent Seminary, Saint Vincent College Corporation, Wimmer Corporation and its and their past, present and future governing bodies, members, managers, directors, officers, employees, agents, insurers, employee benefits plans and their respective trustees and fiduciaries, and all others acting in concert with them, (hereinafter, "Saint Vincent"), shall not be liable for any damages arising from personal injuries (including death) sustained by my/our child in, on, or about the premises, or as a result of the use of the exercise equipment, performance facilities, swimming pool or athletic facilities, regardless of whether such injuries result, in whole or in part, from the negligence of Saint Vincent. By the execution of this agreement, I/we accept and assume full responsibility for any and all injuries, damages (both economic and non-economic), and losses of any type, which may occur to my/our child. I/We hereby fully and forever release and discharge Saint Vincent from any and all claims, demands, damages, rights of action, or causes of action, present or future, whether the same be known or unknown, anticipated, or unanticipated, resulting from or arising out the use of said exercise equipment, swimming pool or athletic facilities. I/We expressly agree to indemnify and hold harmless Saint Vincent against any and all claims, demands, damages, rights of action, or causes of action, of any person or entity, that may arise from injuries or damages sustained by my/our child. I/We agree that my/our child will be solely responsible for his or her own safety and well-being. I understand that Saint Vincent does not provide supervision, instruction, or assistance for the use of the facilities and equipment, unless they have separately agreed to do SO in writing. I/We agree to instruct my/our child to comply with all rules imposed by Saint Vincent regarding the use of the facilities and equipment. I/We agree to instruct my/our child to conduct himself or herself in a controlled and reasonable manner at all times, and to refrain from using any equipment in a manner inconsistent with its intended design and purpose. I/We understand and acknowledge that the use of exercise equipment and swimming pool involves risk of serious injury, including permanent disability and death and I/we assume the inherent risk and dangers of my/our child voluntarily engaging in these activities. I/We understand and agree that Saint Vincent is not responsible for property that is lost, stolen, or damaged while in, on, or about the premises.

  • I/We further expressly agree that the foregoing Release, Waiver and Indemnity Agreement is intended to be as broad and inclusive as is permitted by the law of the State of Pennsylvania and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. I/We explicitly represent to Saint Vincent that I/we am/are at least 18 years of age and that my/our child: a) is physically fit and capable of using the equipment contained in the facility; b) has had a recent physical examination by a competent physician and that my/our child's use of these facilities and equipment is consistent with all medical advice I/we have presently received from medical professionals familiar with my/our child's physical condition; and my child, c) has inspected the facilities prior to their use.

I/We have read the foregoing waiver and release of liability and voluntarily execute this document with full knowledge of its contents.
